Welcome to Oblio, created by Oblio Labs LLC, a company incorporated in the Republic of Serbia (hereinafter referred to as "we", "our", or "us").

We provide our services through our website located at www.obliowallet.ai and through our mobile applications, software, and products (collectively, the "Services" or "Oblio"). Please read carefully these Terms of Service (the "Terms" or "Agreement") along with any other policies or notices on Oblio's website or mobile applications, including our Privacy Policy. All of these materials represent terms, rules, and guidelines related to your use of Oblio.

Overview

Oblio provides:

  • Non-custodial (self-hosted) virtual currency wallet services;
  • An AI-powered interactive assistant ("Lio") to facilitate user inquiries and automated platform interactions;
  • In-wallet virtual currency swap aggregation services;
  • Integrated third-party fiat on/off-ramp interfaces.

By using any of the provided Services (including but not limited to creating or importing a wallet, interacting with our AI assistant, initiating a transaction, visiting our website, or downloading and running our mobile application), you expressly agree to be bound by these Terms. Please read them carefully. If you do not agree to this Agreement or any subsequent modifications, you must immediately cease using all Oblio products and Services.

About This Policy

We reserve the right to alter, modify, or update these Terms at any time at our sole discretion. These changes will take effect immediately upon being posted on our website or within our mobile application. Your continued use of Oblio following any such change will signify your absolute acceptance to be bound by the then-current Terms. Please check the effective date above to determine if there have been any changes since you last reviewed these Terms. Failure or delay by Oblio in enforcing or partially enforcing any provision of these Terms shall not be construed as a waiver of any of our rights.

Eligibility, Sanctions & Restricted Jurisdictions

To be eligible to access and use Oblio, you must be at least eighteen (18) years old and possess the full legal capacity to form legally binding contracts under applicable law.

By accessing or using our Services, you represent, warrant, and covenant that:

  • You are not a citizen, resident, or located in any jurisdiction subject to comprehensive international sanctions, trade embargoes, or financial restrictions (including, but not limited to, sanctions administered by the UN, OFAC, EU, or the Republic of Serbia);
  • You are not individually listed on any international sanctions blocklists, Denied Persons Lists, or Specially Designated Nationals (SDN) lists;
  • Your use of the Services complies with all local laws, rules, and regulations applicable to you.

We reserve the absolute right to change our eligibility criteria, implement geographic restrictions, or refuse access to the Services to any individual or entity at any time without prior notice.

Prohibited Use Policy

You strictly agree that you will not utilize Oblio, its non-custodial wallet, or its AI assistant ("Lio") to engage in, facilitate, or support any illegal, malicious, or fraudulent activities. Prohibited activities include, but are not limited to:

  • Financial Crimes: Money laundering, terrorism financing, proliferation financing, or the evasion of applicable economic sanctions;
  • Cyberattacks & Exploits: Hacking, phishing, distributing malware, viruses, ransomware, or attempting unauthorized access to the platform's servers, smart contracts, or infrastructure;
  • Fraud & Theft: Identity theft, market manipulation, wash trading, front-running, or executing transactions involving explicitly stolen or compromised digital assets;
  • Illicit Commerce: Purchasing, selling, or facilitating transactions for illegal goods, weapons, controlled substances, or unlicensed financial services.

Any violation of this Prohibited Use Policy will result in the immediate termination of your access to our interfaces and Services.

The Blockchain & Platform Services

1. Digital Assets and Wallet Generation

Oblio is a non-custodial software application that:

  • (a) Integrates the OBL token, a cryptographic asset;
  • (b) Generates cryptographic wallet addresses and encrypted private keys that you may use to send, receive, and store supported virtual currencies and cryptographically secured tokens (collectively, the "Virtual Currency").

2. AI Assistant ("Lio") & Investment Disclaimer

The Platform introduces "Lio," an Artificial Intelligence-powered interactive assistant designed to facilitate user queries, assist in investment research, and help automate platform interactions (such as preparing transaction parameters based on your natural language prompts).

  • Initial/Beta Version and Error Acknowledgement: Lio is currently operating in its initial, iterative version. You expressly acknowledge and agree that Lio may generate inaccurate, incomplete, misleading, or erroneous outputs. The Company provides no warranties or guarantees regarding the accuracy, completeness, or reliability of Lio's responses, consistent with the standard limitations of liability applied by major AI providers (e.g., OpenAI, Anthropic).
  • Strict Non-Financial Advice Disclaimer: Lio may provide portfolio rebalancing simulations, market insights, structural analysis, or asset tracking based on your specific prompts or parameters. All outputs, text, data, and responses generated by Lio are strictly for informational, educational, and investment research purposes. Nothing generated or communicated by Lio constitutes financial, investment, legal, tax, or professional advice.
  • User's Sole Responsibility: You retain absolute and exclusive responsibility for all trading, investment, asset allocation, or portfolio rebalancing decisions. The Company shall not be liable for any financial losses, capital depletion, missed opportunities, or damages of any kind resulting directly or indirectly from your interaction with Lio or your reliance on its responses, research, or suggestions.

3. In-Wallet Swaps and Third-Party Aggregators

The Platform provides an integrated, in-wallet exchange interface allowing users to swap Virtual Currencies and tokenized shares.

  • Discontinuation of Native DEX: For the avoidance of doubt, the native decentralized exchange and liquidity providing pool previously known as "Oblio Swap" has been permanently discontinued and removed from the platform. Oblio does not execute swaps directly, does not operate its own decentralized exchange, and does not custody user assets during swaps.
  • Routing via Third-Party Aggregators: All swap transactions initiated within the platform are routed through, and executed by, third-party decentralized liquidity aggregators and partners, including but not limited to: 1inch, LetsExchange, Exolix, nExchange, and StealthEX.
  • Fees: Network execution fees and swap parameters are governed by the respective protocol. Any supplementary operational fees applied by the platform will be displayed transparently prior to execution.

4. Integrated Fiat On/Off-Ramp Services

Users may execute the purchase or sale of Virtual Currencies using credit cards, debit cards, or other supported fiat payment methods directly via integrated third-party service providers, specifically MoonPay and Transak.

  • Execution Mechanism: The AI assistant ("Lio") or the platform's user interface may assist in preparing the transaction parameters based on your instructions, after which you will be redirected to the secure interface of MoonPay or Transak to finalize the payment, compliance (KYC), and execution.

5. Independent Third-Party Relationship & Liability Release

By initiating a swap or executing a fiat-to-crypto purchase/sale via the platform, you explicitly acknowledge that you are entering into a direct contractual and financial relationship with those respective third-party providers (MoonPay, Transak, 1inch, LetsExchange, Exolix, nExchange, StealthEX).

The Company does not control, supervise, operate, or maintain these independent protocols or platforms. We assume zero liability, responsibility, or obligation for the execution, pricing, network slippage, compliance mechanisms, regulatory status, or technical failures of MoonPay, Transak, 1inch, LetsExchange, Exolix, nExchange, StealthEX, or any other integrated third-party partner. Your use of these services is strictly subject to the respective terms of service and privacy policies of those independent providers.

Wallet Address, Private Key, and Backup

An encrypted backup of certain information associated with your wallet can be stored locally on your device in Keystore JSON format or secured via a mnemonic seed phrase. The private key is cryptographically tied to the Oblio public wallet address and, together, they are used to authorize the transfer of Virtual Currency to and from that address.

It is solely and exclusively your responsibility to maintain the security, confidentiality, and integrity of your private key, mnemonic (backup) phrase, passwords, and any access credentials associated with your Oblio wallet.

Failure to secure your mnemonic phrase or private key will result in the permanent and irreversible loss of control over the Virtual Currency associated with your wallet.

Oblio stores your PUBLIC wallet address to deliver core platform functionalities, but Oblio DOES NOT receive, access, or store your wallet password, encrypted private key, unencrypted private key, or mnemonic (backup) phrase.

Consequently, we cannot assist you with password retrieval, private key recovery, or wallet restoration. If you fail to safely store an external backup of your credentials, you accept and acknowledge that you will permanently lose access to any Virtual Currency associated with your account, and the Oblio team cannot retrieve it under any circumstances.

Transactions on the Blockchain

All Virtual Currency transactions must be confirmed and recorded on public, open-source blockchains associated with the respective digital assets. These are decentralized, peer-to-peer networks supported by independent third parties, which we do not own, control, or operate.

Oblio does not control Ethereum (ETH), Tether (USDT), or any other underlying blockchain networks. We cannot and do not guarantee or warrant that any transaction details or orders you submit via the Services will be confirmed, validated, or processed by the network validators. By accepting these Terms, you acknowledge and agree that blockchain transactions may be delayed, congested, or dropped by the respective networks for any reason.

Smart Contracts and Audits

The smart contracts and underlying protocols that Oblio interfaces with may undergo periodic security evaluations or audits. However, we do not guarantee their absolute security, and we explicitly disclaim any warranties that the platform will be free from unforeseen vulnerabilities, exploits, zero-day hacks, malicious code, or economic manipulation.

While our team exerts commercially reasonable efforts to maintain the technical security of our software at the highest possible industry standards, we disclaim all liability and responsibility arising from protocol hacks, smart contract vulnerabilities, viral attacks, or third-party exploits. Digital asset interaction is inherently risky, and security remains an adversarial, evolving space.

No Warranty ("As Is" & "As Available")

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OBLIO EXPLICITLY DISCLAIMS ALL IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES, THE AI ASSISTANT ("LIO"), OR THE PLATFORM INTERFACES WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, ERROR-FREE, OR FREE OF VIRUSES OR MALICIOUS COMPONENTS.

Limitation of Liability & Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OBLIO LABS LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF DIGITAL ASSETS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR CAPITAL DEPLETION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OBLIO'S MAXIMUM AGGREGATE FINANCIAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO OBLIO FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT, OR THE SUM OF ONE HUNDRED EUROS (€100), WHICHEVER IS LESS.

Termination & Suspension

We reserve the absolute right, without prior notice, liability, or justification, to suspend, terminate, or restrict your access to our front-end interfaces, mobile applications, or specific platform features (such as the AI assistant) at our sole discretion, including but not limited to instances where we suspect a breach of these Terms, engagement in Prohibited Uses, structural legal changes, or regulatory enforcement actions. Upon termination, all rights granted to you under these Terms shall immediately cease.

Force Majeure

Oblio shall not be held liable, responsible, or deemed in breach of these Terms for any delay, failure, disruption, or interruption of the Services resulting directly or indirectly from events, causes, or circumstances beyond our reasonable control. Such Force Majeure events include, but are not limited to: open-source blockchain network failures, hard forks, mining/validation congestion, consensus mechanism faults, general internet or telecommunication outages, third-party cloud infrastructure or hosting failures, cyber warfare, systemic hacks, economic or political sanctions, government mandates, strikes, civic unrest, wars, acts of God, or natural disasters.

Governing Law & Dispute Resolution

These Terms, your utilization of the Services, and any disputes, claims, or controversies arising directly or indirectly from this contractual relationship shall be governed by, construed, and enforced exclusively in accordance with the laws of the Republic of Serbia, without regard to its conflict of law principles.

Any dispute, disagreement, or claim arising out of or relating to these Terms, including its formation, validity, breach, or termination, which cannot be settled amicably through good-faith negotiations, shall be subject to the exclusive jurisdiction of the competent courts in Belgrade, Republic of Serbia.
